Proposed Bill on DWI Administrative Law Dies with End of Session

As a Baton Rouge DWI attorney, I am relieved that HB 1204 has died with the end of the 2012 legislative session.  We blogged about this bad bill a few weeks ago.  If you don’t recall, the bill, if it became law, was going to require a license suspension due to a DWI to be upheld even if the individual has their criminal case dismissed or is even acquitted!  Thankfully, though, that will not be the case in Louisiana, at least until the Legislature convenes again perhaps.

However, there was one good thing about this bill.  Namely, it would have extended the time period in which a person could request an administrative hearing after a DWI from 15 days to 30 days.  All in all though, we think the bad outweighed the good in this bill.  In any event, due to the short time period you have to request an administrative hearing, it is imperative that you contact an experienced Baton Rouge DWI attorney immediately if you receive a DWI.
