What Is Considered Sexual Assault?

The term “sexual assault” is often used colloquially to refer to all types of sex crimes, including rape. However, sexual assault—or sexual battery, as it is technically called in Louisiana—is its own offense.

In Louisiana, sexual assault/battery occurs when the alleged offender touches the victim in a sexual way or makes the victim touch the offender in a sexual manner and:

  • The victim did not give consent or;
  • The victim was incapable of giving consent because:
    • He/she was 14 years old or younger or;
    • He/she was at least three years younger than the alleged offender and;
    • The victim and the alleged offender are not married.

Additionally, if the alleged offender is not a minor (18 or older), he/she touches the victim in a sexual way without consent and:

  • The victim was physically incapable of resisting (paralyzed, etc.) or;
  • The victim was mentally incapacitated (and the alleged offender knew or reasonably should have known the victim was mentally incapacitated) or;
  • The victim was 65 years old or older.

Importantly, no sexual penetration need occur for a person to be charged with sexual battery in the State of Louisiana. However, this does not mean that these charges are to be taken any less seriously than rape charges or other sexual offenses charges.

The penalties for sexual assault/battery in Louisiana may include steep fines, extensive prison sentences, and mandatory lifelong registration on the sexual offender registry.
