This is an interesting video of a checkpoint stop on the 4th of July in Tennessee. The kid is not right about checkpoints in general, not being able to stop him and ask for information; but the officer is not right about being able to do so without regard to Constitutional rights. The caveat is of course that you do not hear the officer say anything about ‘no Constitutional rights’…but it is not a stretch to believe he did given his obvious frustration level with this kid.
DWI Checkpoints can be constitutional, but there are clear requirements. If you get stopped and arrested at a DWI Checkpoint, you need to hire an attorney.
